Transgenders get right to inherit property, change gender in Nadra records

PESHAWAR: The National Assembly on Tuesday passed ‘The Transgender Persons (Protection of Rights) Act, 2018 which gives transgender persons their basic rights.

The PPP lawmaker Syed Naveed Qamar presented the bill in the National Assembly. The JUI-F MNA Naeema Kishwer said there are some serious flaws in the bill that need to be rectified. She suggested that the bill should be referred to the standing committee and also to the Council of Islamic Ideology (CII). However, the House rejected her observations.

The bill was earlier unanimously approved by Senate in March this year. Under the bill, eunuchs to be recognised as they perceive themselves. It also provides them basic rights of driving licences, passports, education, right in ancestral property, protection against harassment, loans facility, jobs, right to assembly etc.

Under the bill, anyone found guilty of forcing a transgender person to be will face six months jail and Rs50,000 fine. They will also have the option to get their gender changed in National Database and Registration Authority (Nadra) records.

The right to change gender in Nadra records is very significant for transgenders as by declaring them as ‘male’ they can get full share in ancestral property, while by declaring them ‘female’ they can get half share in property.

The transgender persons expressed happiness over approval of the bill and hoped that it will prove a milestone in protection of their rights.
